  • Does the real estate agent need to provide photographs?

Can My Rental Bond Be Used to Pay for Cleaning?

This is an important question.

In NSW, a landlord or managing agent can make a claim against a rental bond for the reasonable cost of cleaning parts of a property that have not been left reasonably clean, taking into consideration the property's condition at the beginning of the tenancy.

That does not mean the bond is automatically available as a general cleaning fund.

If a landlord or agent makes a bond claim without the tenant's agreement, NSW Government guidance says they must provide the tenant with the end-of-tenancy condition report and copies of relevant estimates, quotes, invoices or receipts within the required timeframe.

What Happens to My Bond After I Move Out?

Once the tenancy has ended, a bond refund can be claimed through Rental Bonds Online where applicable.

The landlord, agent or tenant can submit a claim.

If the landlord or agent makes a claim that the tenant disagrees with, there is a process for disputing it.

NSW Government guidance indicates that tenants receiving a Notice of Claim generally have a 14-day notice period to respond.

Where a dispute cannot be resolved, it may ultimately be considered by the NSW Civil and Administrative Tribunal (NCAT).

Tenants should obtain current information directly from NSW Fair Trading or Service NSW if they have a dispute regarding their bond.
